Terms of Use

Meraki Technologies LLC (the “Company,” “we,” “us,” “PayAt” and “our”) offers cash back
in the form of credits issued to the PayAt
Credits balance when a Qualified Purchase at participating merchants is made. A “Qualified Purchase” is
a purchase from a participating merchant in accordance with the terms of the Offer and these terms (the
“Terms”). An “Offer” is
the cash back percentage or amount in form of PayAt Credits or gift card offered by the merchant, which
may include, but not limited to, a
minimum transaction amount, expiration date, any other additional terms or limitations associated to the
offer.
These Terms of Use (“Terms”) govern your access to and use of (1) our website located
at www.payat.app and all of our other websites to which these Terms are posted (collectively, the
“Website”); (2) our mobile applications to which these Terms are posted (collectively, the
“Application”); and (3) any services, content, and features made available by us through the Website or
the Application (together with the Website and the Application, the “Services”). In these Terms, “you”
and “your” refer to any user of the Services.
YOUR ACCEPTANCE OF THESE TERMS
By accessing or using the Services in any way or by clicking to agree to these Terms when that option is made available to you, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by this reference into these Terms. If you do not agree to all the terms and conditions of these Terms, do not access or use the Services. If your access to or use of the Services is prohibited by applicable law, you are not authorized to access or use the Services. We are not responsible if you access or use the Services in any manner that violates applicable law.
CHANGES TO THESE TERMS
We may, without prior notice or liability to you, discontinue the Services or modify the Services by adding or removing features or functionalities, even though such changes may affect the Company (as defined below) awarded to you. We may also revise these Terms from time to time in our sole discretion, subject to applicable law. When we revise these Terms, we will post a revised version on the Website and the Application. You are free to decide whether or not to accept a revised version of these Terms, but accepting these Terms, as revised, is required for your continued access to and use of the Services. If you do not agree to these Terms or any revised version of these Terms, your sole recourse is to terminate your access to and use of the Services. Except as otherwise expressly stated by us, your access to and use of the Services are subject to the version of these Terms in effect at the time of your access or use.
ACCOUNT REGISTRATION
THE SERVICES ARE NOT AVAILABLE TO PERSONS UNDER THE AGE OF 18 OR TO ANY USERS SUSPENDED OR
REMOVED FROM THE PROGRAM. BY USING THE SERVICES, YOU REPRESENT THAT YOU ARE AT
LEAST 18 YEARS OF AGE AND HAVE NOT BEEN PREVIOUSLY SUSPENDED OR REMOVED FROM THE PAYAT.
SUBJECT TO YOUR COMPLIANCE WITH THESE TERMS AND ALL APPLICABLE LAWS, Meraki Technologies LLC. grants you
permission
to access and use Services for your personal or business use, at the level for which you
have registered, as set forth in these Terms and consistent with the intended features of the Services.
In order to use the Services, you must have a PayAt account in good standing. You agree that the
information you provide to the Company on registration and at all other times, will be true,
accurate, current, complete and that you will keep this information accurate and up-to-date at all times
and you represent and warrant that you are authorized to use the payment card that you submitted.
By registering for or interacting with the Services you represent that you have read and
accepted the Terms of Use and the Privacy Policy.
You are solely responsible for ensuring the confidentiality of your Account login information and
maintaining the security of such information. You agree not to authorize any other person to use your
Account for any purpose. Except as otherwise provided by applicable law, you are solely responsible for
all transactions and other activities authorized or performed using your Account, whether authorized by
you or not. If you believe any of your Account credentials, such as your password, have been obtained or
used by any unauthorized person or you become aware of any other breach or attempted breach of the
security of the Services or your Account, you must notify us immediately.
SALE OF Gift Cards
By accessing the Application, by making transactions through Application, by accepting or
using any Gift Card (as defined below) purchased through Application or specifically by clicking a
checkbox
for
“I agree” or similar statements, in each case, you expressly indicate to the Company and
their
respective subsidiaries, affiliates, distributors and agents your
acknowledgment and acceptance of these Terms of Use, which are expressly incorporated
herein. We, in our sole discretion, may revise these Terms of Use at any time or make
changes to the Application at any time, with or without notice, and your subsequent accessing of
it,
making
transactions through the Application, accepting or using any Gift Card purchased through the Application
or
clicking a checkbox for “I agree” or similar statements, in each case, will serve as your acknowledgment
and acceptance of such changes. These Terms of Use control your use of and participation
with the Company and no covenants at law or in equity shall be implied or incorporated. We the sole
right
to interpret and apply all terms as it sees fit.
PayAt is available only to the members physically located in the UAE. You may have only one account at a
time. Any offer for any products or services made in
or through PayAt is void where prohibited.
Terms of use for Gift cards purchased from the Application are as follows:
- Gift cards are non-refundable and cannot be exchanged for cash unless required by law. For
issues with your gift card, please first reach out to our retail partner’s support channels.
Should the gift card be invalid, PayAt may assist with looking into the issue but is not
required
to issue refunds if the issue is on the retail partner’s side.
- PayAt respects the rights of our retail partners to make decisions on their acceptance of gift
cards. If the retailer cancels any orders made with the gift cards, the Company is not liable
and will
not reimburse those transactions. If retailers decide to terminate your access to their site,
stores or those said gift cards, the Company is not liable and will not reimburse those
transactions.
- The gift cards being purchased are intended for personal use.
- Gift cards are as good as cash and the Company securely delivers gift cards directly to your
app.
Users
are responsible to ensure the security of their gift cards and the mobile devices/ computers
they access the Application through. the Company will not refund lost or redeemed gift cards
caused by
compromised
accounts and/or devices.
- Majority of gift cards only work in the UAE, the Company will not refund gift cards that do not
work if they are redeemed outside of the UAE or with a non-UAE. or non AED account. Please check
the retail partner’s gift cards T&Cs and FAQs prior to purchasing a gift card.
- The Company is not responsible if the retail partner’s cashiers, staff and managers do not know
how to
use gift cards. Please inform the cashier that you are using the retail partner’s DIGITAL gift
card. In most cases, cashiers are able to either scan or enter the gift card code and pin or
both.
- The Company clearly reflects if gift cards are useable in-store, online or both. The usage of
the gift
cards are subject to the retail partner’s terms and conditions. The Company will not refund gift
cards
if the app states in-store only but the user was unable to use online, and vice versa.
- The gift cards are subject to the retail partner’s Terms and Conditions. The Company is not
liable to
refund gift cards that encountered issues on the retail partner’s side such as website
maintenance or system error.
- Users are liable to check the expiry date of their gift cards. The Company will not refund
un-useable
gift cards because they have expired.
- Depending on retail partner’s T&Cs, gift cards may be limited to certain products, services
and/or branches only. The Company is not required to refund gift cards for cases like this.
Please
visit the retail partner’s gift card FAQs prior to purchase. The Company is not responsible for
merchant's stock/ inventory levels.
- Once a gift card purchase has been made, The Company is unable to change the amount.
- The Company is simply the gift card seller. Gift cards are completely subject to the retail
partner’s
Terms and Conditions. Our retail partner reserve the right to cancel orders, lock accounts (and
the balances along with it), terminate access to their website and/or stores, and defund or
deactivate gift cards without refunds based on their terms & conditions or as they see fit.
The Company
is not liable for our retail partner’s decisions and will not reimburse those gift cards.
- Merchandise returns and order cancellations from orders purchased with a gift card are subject
to retail partner’s Terms and Conditions. Should you want to return merchandise or encounter
issues with your balance after you cancelled your order, please reach out to the retail partner
directly.
- Please visit our retail partners website to check your gift card balance. For some retail
partners, a user account is needed to redeem the gift card balance and/or check the balance.
- Should a chargeback be received from your account and/or linked payment methods, the Company
reserves
the right to require payment of the chargeback amount and a AED 100 processing fee prior to
reinstating your account. The Company reserves the right to lock your account, your gift card
balances
and PayAt Credit balance along with it, should you receive numerous chargebacks and/or to pay
for
chargeback charges. The Company is not required to re-open your account.
- In an effort to ensure the security of all cards used in the app, the Company reserves the right
to
lock accounts, the balances and PayAt Credits if the account is suspected to be fraudulent.
The Company
reserves the right to conduct account verification any time.
- Gift cards are subject to stock availability. Gift cards need to be used to pay for a purchase,
Gift cards cannot be used retroactively.

In each purchase transaction, you are purchasing a merchant-specific electronic stored
value card, certificate, voucher or similar product that will be displayed on your smartphone or
other compatible device as an electronic code, symbol, set of letters, set of numbers or
any combination thereof (“Gift Card”), and the Gift Card is intended to be redeemed for the full
amount of the Gift Card immediately with such merchant (the “Merchant”) for your desired
products or services.
- Any returns, credits or exchanges of the products or services that are purchased using such a
Gift Card via The Company will be governed by the applicable Merchant’s policies, terms and
conditions
for purchases made with Gift Cards. Such Merchant’s policies, terms and conditions may be
subject to change in the Merchant’s sole discretion, if permitted by law. You may be entitled
only to store credit with any return or exchange. For details, review the applicable gift card
terms available in the purchase path, and contact the applicable Merchant for additional
information.

Except as specifically permitted by the Merchant’s policies, terms and conditions, Gift Cards
are not redeemable for cash or for other Merchants’ Gift Cards, are not valid for prior
purchases and may not be returned, credited or exchanged.
- We are not responsible for keeping track of your available Gift Card balance, if any.
- If we fail to deliver a Gift Card you have purchased, we deliver a Gift Card with an electronic
code that does not function properly, or you have a question about rewards awarded in connection
with any of the transaction, please contact us using the contact method listed within the
application.
- Disputes or claims regarding any failure of any Gift Card to be purchased or delivered, or any
other failure related to using the application to complete your transaction, will be subject to
these
Terms of Use, and neither the Merchant, nor the issuer of the payment card (or other
payment product) used to purchase the Gift Card (the “Issuer”), nor any non-merchant distributor
of the Gift Card (“Distributor”), shall have any responsibility with respect to such disputes or
claims.
- If you are entitled to a refund for any reason for products or services obtained with a Gift
Card, you agree to accept credits to a Gift Card or a replacement Gift Card for such refunds or
such other handling as provided in the applicable Merchant’s policies, terms and conditions. If
you have a problem with a purchase that you made with your Gift Card, or if you have a dispute
with the Merchant, you must handle it directly with the Merchant. Any disputes or claims
relating to Gift Cards that are purchased or delivered using PayAt, including without limitation
any disputes or claims relating to products or services purchased with any Gift Card, must be
handled in accordance with the applicable Merchant’s policies, terms and conditions, and none of
the Company, the Issuer and any Distributor shall have any responsibility with respect to such
disputes
or claims.
- Gift cards are subject to merchant's terms & conditions. Check merchant's website for redemption
terms prior to purchase of gift card from the application. Any redemption issues due to
merchant's
restrictions does not make you eligible for a refund from The Company.
PayAt
Credits
Receiving PatAt Credits
Subject to these Terms, we will automatically provide PatAt Credits to you when you purchase
qualifying
goods or
services. The Company, in
its sole discretion, establishes the terms and conditions for each qualifying purchase or action and
determines whether you have satisfied such terms and conditions to receive PatAt Credits. Such terms
and
conditions are set forth on the Website and the Application and may be updated, modified, suspended,
or
cancelled by the Company at any time in its sole discretion. All offers made available to you
through
the PatAt application are temporary and may become unavailable without notice. You may also have a
limited, prescribed window of time to take advantage of an offer. Always check the PatAt application
for
offers currently available to you. Not all qualifying purchases made with your Payment Card may be
eligible for PatAt Credits if we are unable to
obtain certain transaction information from the Merchant.
Without limiting any of the other terms of these Terms, if you return, charge back, cancel, dispute,
or
otherwise request a refund for a qualifying purchase for which you have already received PatAt
Credits,
we will
reduce the balance of PatAt Credits in your Account by the amount of PatAt Credits you received for
such
transaction. If
the balance of PatAt Credits in your Account is less than the amount of PatAt Credits you received
for
such transaction,
we will offset the applicable amount of PatAt Credits from Credits you would otherwise receive for
future qualifying
actions.
PatAt Credits that you receive as a result of a qualifying purchase at a local merchant will
generally
be
reflected in your Account within 1-7 Business Days after the date of purchase. PatAt Credits that
you
receive as
a result of a qualifying online purchase will be reflected in your Account after the return period
for
the purchase has expired and generally within 60-90 Business Days after the online purchase is
completed.
Without limiting any of the other conditions of these Terms, if we award PatAt Credits to you in
error
(e.g., we
later determine that you did not comply with the terms and conditions of a qualifying purchase or if
you
charge back a qualifying purchase), we reserve the right to remove the applicable PatAt Credits from
your
Account. You are responsible for making sure the PatAt Credits balance reflected in your Account is
correct. If
you believe that your Account does not accurately reflect PatAt Credits that you are eligible to
receive, please
contact us.
PatAt Credits will remain in your Account until we approve redemption of PatAt Credits as described
below.
Redeeming PatAt Credits
Subject to these Terms and our approval, you may request that we redeem PatAt Credits from your
Account.
Prior to
redeeming PatAt Credits, (i) you must verify an email address associated with your Account, (ii)
PatAt
Credits may only be
redeemed from your Account through the Website and the Application, (iii) you must have completed an
offer-qualifying transaction with a participating merchant. (iv) PatAt may offer the ability to
purchase
Gift
Cards through the app using PatAt Credits or a combination of rewards and money.
You are solely responsible for verifying the accuracy and completeness of any credits to your
Redemption
Method performed by us hereunder. You must notify us of any errors within 15 days of such
information
being made available to you. If you do not notify us of any such errors within such 15 days, you
will
forfeit the right to contest a transaction, except to the extent such forfeiture is prohibited by
applicable law.
Certain limits may apply to your redemption of PatAt Credits. For example, unless otherwise
permitted by
us, you
may only redeem PatAt Credits up to the daily limit set by the Company. Without limiting any of the
other
conditions of these Terms, we may modify the redemption terms for PatAt Credits at any time in our
sole
discretion.
Unauthorized or Fraudulent Transactions and Transaction Limits
The minimum and
maximum amounts that may be spent by a member
via PatAt during a
certain time period (e.g., per day), per Merchant, per transaction and other limits and restrictions
will be set by Company in its sole discretion and are subject to change. Limits or other
restrictions
may
vary by member. If the Company, in its sole discretion, believes that you are purchasing gift cards
at a
volume or denomination that is intended to abuse the Services or that appears to be consistent with
manufactured spending, the Company retains the right to suspend and/or terminate your Account and
claw
back any PatAt Credits received as a result of the gift card abuse.
If you notice unauthorized or fraudulent transactions on the account of any Registered
Card, promptly contact your credit card issuer to report it. It is important to continually monitor
your credit card accounts to identify any unauthorized or fraudulent transactions. You may have a
limited time to notify your credit card issuer. Refer to the terms available from your credit card
issuer regarding unauthorized or fraudulent transactions for additional information.
Because any stored Gift Card numbers or Gift Card barcodes, including any unused credits
stored in your PatAt account, are Gift Cards that can be used like cash for purchases from the
applicable Merchant and because PatAt rewards can be used to purchase Gift Cards (where available),
you are responsible for all transactions made with your unused credits and your PatAt Credits,
including unauthorized or fraudulent transactions. If you notice unauthorized or fraudulent use of
any unused credits or rewards in your PatAt account or otherwise, contact PatAt as soon as possible
using the contact method listed within the PatAt application or found on PatAt.app
By utilizing Services, you agree to not dispute any transaction initiated by you via
the PatAt app. You also understand that PatAt will not provide refunds for goods or services it has
provided. All claims of potential or actual fraud must be initiated and settled by the PatAt Account
holder’s financial institution.
Please allow 1-4 business days (excluding bank holidays) for settlement of all transactions
initiated on the PatAt app. PatAt's goods and Services will not be provided until the applicable
transaction has settled. Cancellation requests made by the PatAt Account holder may not be fulfilled
based on the transaction status as of the day and time of the request.
PatAt reserves the right to initiate, pend, cancel, and refund transactions at its sole
discretion in instances of potential or actual fraud or promotion abuse based on, but not limited
to, the following factors: PII; Payment Method, device identifiers; or suspicious activity within
the PatAt app. PatAt reserves the right to withhold delivery of goods and Services until potential
or
actual fraud or promotion abuse is investigated or for up to 14 business days past the settlement
date of the applicable transaction(s). In the instance of returned transaction, PatAt reserves the
right to payment recovery by initiating a transaction of the same amount from the Account holder’s
Payment Method.
THIRD-PARTY CONTENT
The information presented through the Services is made available solely for general information
purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any
reliance you place on such information is strictly at your own risk. We disclaim all liability and
responsibility arising from any reliance placed on such materials by you or any other user of the
Services. The Services may include content provided by third parties, including content provided by
other users of the Services. All statements and/or opinions expressed in such content (other than
the content provided by the Company) are solely the opinions and the responsibility of the provider
of the content and do not necessarily reflect the opinion of the Company. We are not responsible, or
liable to you or any third party, for the content provided by any third party.
SUSPENSION AND TERMINATION
We may, in our sole discretion, suspend, limit, or terminate your Account and your access to and use
of the Services, including the PayAt Credits balance in your Account, at any time for any reason,
without
notice or liability to you, including, but not limited to, if we suspect that your access to or use
of the Services violates these Terms or applicable law. You may stop using the Services and
terminate your Account at any time by Contacting Us. Upon the
termination of your Account, you must
cease all use of the Services, and you shall forfeit any PayAt Credits balance remaining in your
Account.
Termination of your Account and your access to and use of the Services will not affect any of our
rights or your obligations arising under these Terms prior to such termination. In the event you or
PayAt terminates your Account, you agree that we may retain your data, including personal and
transaction information, for one year from the date of termination for audit and merchant invoicing
purposes. Provisions of these Terms that, by their nature, should survive termination of your
Account and your access to and use of the Services will survive such termination.
INDEMNIFICATION
You agree to indemnify, hold harmless, and (at our request) defend us, our affiliates, our
distributors, our and
their respective employees, officers, directors, and agents, as well as the Payment Card Networks,
from and against all claims, demands, suits, damages, costs, lawsuits, fines, penalties,
liabilities, and expenses, including reasonable attorneys’ fees, that arise from any third-party
claim due to or arising out of: (a) User Content you share through the Services; (b) your use of the
Services; (c) your breach or alleged breach of these Terms; (d) your violation of applicable law,
including, but not limited to, infringement of third-party intellectual property rights; or (e) your
other actions or omissions that result in liability to us. We reserve the right, at your expense, to
assume the exclusive defense and control of any matter for which you are required to indemnify us
under these Terms, and you agree to cooperate with our defense of these claims.
DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR
ACCESS TO AND USE OF THE SERVICES AND ALL INFORMATION, PRODUCTS, AND OTHER CONTENT (INCLUDING THAT
OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE THROUGH THE SERVICES ARE AT YOUR OWN RISK. TO THE
FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS
AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, AND WE AND THE PAYMENT CARD NETWORKS EXPRESSLY
DISCLAIM ANY AND ALL CONDITIONS, REPRESENTATIONS, WARRANTIES, EXPRESS OR IMPLIED, STATUTORY, OR
OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF TITLE, MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE AND THE PAYMENT CARD NETWORKS MAKE NO WARRANTY THAT (A) THE
SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR
ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR
RELIABLE; (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR
OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN THE SERVICES
WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR ANY OF OUR AUTHORIZED
REPRESENTATIVES WILL CREATE ANY WARRANTY.SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR
LIMITATIONS OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
HOWEVER, ANY LIMITATION WILL BE CONSTRUED TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
LIMITATIONS OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE, OUR AFFILIATES, THE PAYMENT CARD NETWORKS,
AND THEIR AND OUR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS WILL NOT BE LIABLE FOR
DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR
USE OF THE SERVICES OR ANY INFORMATION, PRODUCTS, OR OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES)
INCLUDED IN OR ACCESSIBLE THROUGH THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT,
SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING, BUT NOT
LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF
PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND
WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF
FORESEEABLE. WITHOUT LIMITING THE FOREGOING AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW,
IN THE EVENT YOU OR ANY OTHER PERSON OR ENTITY IS ENTITLED TO DIRECT DAMAGES ARISING OUT OF OR IN
CONNECTION WITH YOUR ACCESS, USE, OR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY INFORMATION,
PRODUCTS, OR OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE THROUGH THE
SERVICES, THE COLLECTIVE LIABILITY OF THE COMPANY, OUR AFFILIATES, THE PAYMENT CARD NETWORKS, AND
OUR AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS, (REGARDLESS OF THE FORM OF
ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED AED 100.
IN ADDITION TO AND WITHOUT LIMITING ANY OF THE FOREGOING, WE AND THE PAYMENT CARD NETWORKS WILL HAVE
NO LIABILITY FOR ANY FAILURE OR DELAY RESULTING FROM ANY CONDITION BEYOND OUR REASONABLE CONTROL,
INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, ACTS OF TERRORISM, LABOR CONDITIONS, POWER FAILURES,
INTERNET DISTURBANCES, OR ANY SERVICES OR SYSTEMS CONTROLLED BY THIRD PARTIES. THE LIMITATIONS IN
THIS SECTION DO NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Subject to these Terms, we will automatically provide PatAt Credits to you when you purchase qualifying goods or services. The Company, in its sole discretion, establishes the terms and conditions for each qualifying purchase or action and determines whether you have satisfied such terms and conditions to receive PatAt Credits. Such terms and conditions are set forth on the Website and the Application and may be updated, modified, suspended, or cancelled by the Company at any time in its sole discretion. All offers made available to you through the PatAt application are temporary and may become unavailable without notice. You may also have a limited, prescribed window of time to take advantage of an offer. Always check the PatAt application for offers currently available to you. Not all qualifying purchases made with your Payment Card may be eligible for PatAt Credits if we are unable to obtain certain transaction information from the Merchant.
Without limiting any of the other terms of these Terms, if you return, charge back, cancel, dispute, or otherwise request a refund for a qualifying purchase for which you have already received PatAt Credits, we will reduce the balance of PatAt Credits in your Account by the amount of PatAt Credits you received for such transaction. If the balance of PatAt Credits in your Account is less than the amount of PatAt Credits you received for such transaction, we will offset the applicable amount of PatAt Credits from Credits you would otherwise receive for future qualifying actions.
PatAt Credits that you receive as a result of a qualifying purchase at a local merchant will generally be reflected in your Account within 1-7 Business Days after the date of purchase. PatAt Credits that you receive as a result of a qualifying online purchase will be reflected in your Account after the return period for the purchase has expired and generally within 60-90 Business Days after the online purchase is completed.
Without limiting any of the other conditions of these Terms, if we award PatAt Credits to you in error (e.g., we later determine that you did not comply with the terms and conditions of a qualifying purchase or if you charge back a qualifying purchase), we reserve the right to remove the applicable PatAt Credits from your Account. You are responsible for making sure the PatAt Credits balance reflected in your Account is correct. If you believe that your Account does not accurately reflect PatAt Credits that you are eligible to receive, please contact us. PatAt Credits will remain in your Account until we approve redemption of PatAt Credits as described below.
Redeeming PatAt Credits
Subject to these Terms and our approval, you may request that we redeem PatAt Credits from your Account. Prior to redeeming PatAt Credits, (i) you must verify an email address associated with your Account, (ii) PatAt Credits may only be redeemed from your Account through the Website and the Application, (iii) you must have completed an offer-qualifying transaction with a participating merchant. (iv) PatAt may offer the ability to purchase Gift Cards through the app using PatAt Credits or a combination of rewards and money.
You are solely responsible for verifying the accuracy and completeness of any credits to your Redemption Method performed by us hereunder. You must notify us of any errors within 15 days of such information being made available to you. If you do not notify us of any such errors within such 15 days, you will forfeit the right to contest a transaction, except to the extent such forfeiture is prohibited by applicable law.
Certain limits may apply to your redemption of PatAt Credits. For example, unless otherwise permitted by us, you may only redeem PatAt Credits up to the daily limit set by the Company. Without limiting any of the other conditions of these Terms, we may modify the redemption terms for PatAt Credits at any time in our sole discretion.
If you notice unauthorized or fraudulent transactions on the account of any Registered Card, promptly contact your credit card issuer to report it. It is important to continually monitor your credit card accounts to identify any unauthorized or fraudulent transactions. You may have a limited time to notify your credit card issuer. Refer to the terms available from your credit card issuer regarding unauthorized or fraudulent transactions for additional information.
Because any stored Gift Card numbers or Gift Card barcodes, including any unused credits stored in your PatAt account, are Gift Cards that can be used like cash for purchases from the applicable Merchant and because PatAt rewards can be used to purchase Gift Cards (where available), you are responsible for all transactions made with your unused credits and your PatAt Credits, including unauthorized or fraudulent transactions. If you notice unauthorized or fraudulent use of any unused credits or rewards in your PatAt account or otherwise, contact PatAt as soon as possible using the contact method listed within the PatAt application or found on PatAt.app
By utilizing Services, you agree to not dispute any transaction initiated by you via the PatAt app. You also understand that PatAt will not provide refunds for goods or services it has provided. All claims of potential or actual fraud must be initiated and settled by the PatAt Account holder’s financial institution.
Please allow 1-4 business days (excluding bank holidays) for settlement of all transactions initiated on the PatAt app. PatAt's goods and Services will not be provided until the applicable transaction has settled. Cancellation requests made by the PatAt Account holder may not be fulfilled based on the transaction status as of the day and time of the request.
PatAt reserves the right to initiate, pend, cancel, and refund transactions at its sole discretion in instances of potential or actual fraud or promotion abuse based on, but not limited to, the following factors: PII; Payment Method, device identifiers; or suspicious activity within the PatAt app. PatAt reserves the right to withhold delivery of goods and Services until potential or actual fraud or promotion abuse is investigated or for up to 14 business days past the settlement date of the applicable transaction(s). In the instance of returned transaction, PatAt reserves the right to payment recovery by initiating a transaction of the same amount from the Account holder’s Payment Method.
IN ADDITION TO AND WITHOUT LIMITING ANY OF THE FOREGOING, WE AND THE PAYMENT CARD NETWORKS WILL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY RESULTING FROM ANY CONDITION BEYOND OUR REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, ACTS OF TERRORISM, LABOR CONDITIONS, POWER FAILURES, INTERNET DISTURBANCES, OR ANY SERVICES OR SYSTEMS CONTROLLED BY THIRD PARTIES. THE LIMITATIONS IN THIS SECTION DO NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
